Determining Fair And Reasonable Compensation
Pursuing an inappropriate amount of compensation is sure to receive an unfavorable response in court. Fortunately, there are laws and precedents set with guidelines for the maximum amount of compensation depending on the type of claim and injury it is. A lawyer will carefully calculate for you what compensation to pursue is.
Factors Influencing Compensation Amounts
- Injury severity. The more damage, the higher the compensation. A catastrophic injury will result in a higher settlement than a non-catastrophic injury.
- Recovery period. A permanent injury, long-term injury, or disability as a result of the accident will equate to higher compensation.
- Impact of the accident on income. An injury that has impacted your ability to earn income will result in a higher compensation amount. If you are unable to work or have other disruptions, such as inability to attend school, training, vacation, or special event, this all has an effect on compensation.
- Existing legislation. In personal injury law, there is applicable legislation that acts as guidelines to compensation amounts.

Our Fees
For personal injury, disability, and employment cases, we work on a contingency fee basis, which means you will only have to pay a fee if and when we obtain a settlement or judgment in your case.
We understand that many of our clients struggle financially after a life-changing event, such as a car accident, and we therefore give our clients the ability to retain us without having to pay for our services up front. In a case, we also cover any expenses, known as disbursements, which are only paid back out of a settlement or judgment. Further, if your case is not successful, you will not be required to pay us any fees.
In accordance with the Law Society of Ontario, we generally charge a contingency fee between 20% and 33% of your settlement, plus HST. However, the percentage we decide to charge will be based on the severity of your injuries and the complexity of your case.
