Dedicated • Compassionate • Experienced: Your Personal Injury Lawyer

Joshua Goldberg Law

Joshua Goldberg Law, a team of renowned Toronto personal injury lawyers, that serves clients throughout the GTA.

Personal Injury Law Overview

As your personal injury lawyer, it is our duty to use our extensive knowledge in this category of law to fight tirelessly for you. Whether it’s a motor vehicle accident, long term disability denial, wrongful death, or a general personal injury, these claims all fall within our experience and expertise.

Our goal is to build the strongest case for you and to get you the most compensation available to you.

Scope Of Personal Injury Law

Personal injury includes anyone injured in an accident that may have been the result of another party’s negligence or recklessness. Depending on the circumstances, this could mean a quiet settlement arrived at outside the courtroom or having to go toe-to-toe with an insurance company in a complex trial.

It’s our goal as your personal injury lawyer to deliver results and to help you in your long-term recovery.

Importance Of Legal Expertise In Personal Injury Claims

While injuries can appear similar, the details of a client’s case are never the same. How we build a case depends on the specific facts and nature of your case. For example, a client injured in two motor vehicle accidents will be handled differently from a client who was injured in a pedestrian accident. All types of accidents fall under our area of personal injury practice, but each case is run according to the specific facts of the case.

It’s key to hire a personal injury lawyer with a wealth of experience and knowledge in the field, and who has handled your type of case before.

Corner Icon Role Of A Personal Injury Lawyer

You are not legally required to hire a personal injury lawyer to pursue a claim. Though you can attempt the legal process on your own, any personal injury victim is strongly recommended and advised to hire a lawyer.

A lawyer brings with them extensive knowledge and invaluable experience to help you navigate the pitfalls, preparing your claim to maximize its chance of success and to ensure you put forth your best argument for compensation.

In addition to acting as your representative, it’s our duty to provide objective advice, ensuring you are well-informed on any and all decisions you make regarding your claim. This can resolve disputes faster and will ensure your rights are respected by all parties.

How Legal Teams Assist Clients

Any traumatic accident victim and their family will be going through a lot. Medical bills racking up. An interruption to all aspects of your life. The pain and discomfort of the injury. As you’re struggling with everything that comes along with it, the last thing you want to have to do is learn law. That’s where our legal team comes in.

Let us help. With the best lawyers at your side, we can assert your rights, guide you through the claims process, and shield you from the stress of having to go at it alone.

Importance Of Legal Expertise In Challenging Cases

To secure a fair settlement, you want a lawyer who is adept at handling challenging cases. Not all personal injuries are as straightforward as others. The right personal injury lawyer will understand how to present an injury, establish guilt, stick to the facts, and provide supporting evidence to every aspect of your claim. Experience-supported strategies will lay the groundwork for a win in your claim.

Interaction With Insurance Adjusters And At-Fault Parties

There may be multiple parties you are pursuing legal action against. Insurance adjusters and at-fault parties will not want to pay you as much as you are rightfully owed. They will want to shrotchange you and will try to get you to accept a settlement that is not adequate. Have a lawyer with expertise in negotiations who will not accept anything less than what you are owed by law.

The Personal Injury Claim Process

Initial Consultation And Case Evaluation

The first step in any personal injury claim is to sit down with a personal injury lawyer in a free no obligation consultation. For injury victims in need, this provides you the chance to let us know the details of what’s happened and an experienced lawyer will review your case. Before moving forward, we will determine whether your claim is viable. If it is, a lawyer will explain the steps to come in the legal process.

Legal Steps In A Personal Injury Lawsuit

After the consult, the real work begins. A lot of work goes into obtaining the evidence to back your claim. As we submit your claim and all the paperwork involved, we will help you navigate through the frustrating process of dealing with insurance agencies. If necessary, we will be ready to progress to court to deal with any other parties and/or insurers involved.

Gathering Evidence And Medical Documentation

A large part of building a case is establishing not only what happened in the accident but the severity of your injuries. This is done by way of medical documentation. We will connect you with top medical professionals to ensure you receive the care and attention you need to recover as well as to document your recovery and how your injuries are impacting you on a daily basis.

Negotiations With Insurance Providers

There is incentive to settle the case out of court. At this point, however, an insurance company may refuse to provide the resources you need to recover. They will try to downplay your injuries or deny the agreed-upon details of what happened. It’s key to have a lawyer experienced with insurance disputes to get the best settlement possible and present the argument that if things progress to court, the other party will lose.

Trial Preparation And Litigation Process

A personal injury claim may progress to trial. This is what we’re prepared for. The evidence is gathered, disclosed, and ready. A statement is prepared to outline your legal position and to explain why you’re owed damages. Your lawyer is ready to elaborate and defend this position, and will aid you in preparing for the events ahead as you engage in the court process.

Special Considerations In Personal Injury

Dealing With Major Trauma And Long-Term Disability

Trauma of an accident lasts. It is often tagged with some form of long-term disability that can restrict work and impact daily life. To help in your recovery, you need access to services. An experienced lawyer at Joshua Goldberg Law can aid with finding the necessary medical care, help you decode your insurance policy, and protect your financial security with a settlement that covers the associated expenses.

Emotional Well-Being And Psychological Impacts

The mental health impact of a personal injury can extend to negative cognitive, behavioral, and emotional effects. It can impact not only your daily living but your relationships and physical health as well. Too often, psychological impacts are not considered when discussing personal injury cases. Insurers will try to downplay the negative effects of emotional well-being and psychological impacts but they’re important.

Financial Security Post-Accident

A notable impact on your life after a personal injury is what happens to your financial security. Your income and work prospects are temporarily affected, if not permanently. A victim’s financial security is shattered. Recovery only adds to the costs of living as well. Trying to get back on track can feel like an impossibility without securing the financial support by way of compensation you are rightfully owed.

Ensuring A Successful Outcome Through Timely Actions

With any personal injury, you may not know what to do. To ensure a successful outcome to your personal injury claim, here’s what to do.

  • Be evaluated by a physician for any injuries. Not all injuries are obvious and certain conditions may not show symptoms for days after a motor vehicle accident.
  • Collect as much information as you can, including names, license plate numbers, location, insurance providers, and other details. Take photos of the scene and of your injuries. Document everything you can.
  • Collect the information of any witnesses present at the scene who can back up your claim.
  • Reach out to a lawyer specializing in your specific type of injury and your type of personal injury claim.

Corner Icon  Compensation And Settlements

Determining Fair And Reasonable Compensation

Pursuing an inappropriate amount of compensation is sure to receive an unfavorable response in court. Fortunately, there are laws and precedents set with guidelines for the maximum amount of compensation depending on the type of claim and injury it is. A lawyer will carefully calculate for you what compensation to pursue is.

Factors Influencing Compensation Amounts

  • Injury severity. The more damage, the higher the compensation. A catastrophic injury will result in a higher settlement than a non-catastrophic injury.
  • Recovery period. A permanent injury, long-term injury, or disability as a result of the accident will equate to higher compensation.
  • Impact of the accident on income. An injury that has impacted your ability to earn income will result in a higher compensation amount. If you are unable to work or have other disruptions, such as inability to attend school, training, vacation, or special event, this all has an effect on compensation.
  • Existing legislation. In personal injury law, there is applicable legislation that acts as guidelines to compensation amounts.
  • Type of medical treatment. After an injury, if your rehabilitation is more costly – such as if there’s physical therapy, vocational training or counseling, workplace or home modifications, etc. – this may be covered under your compensation claim.
  • Cause and contribution to the injury. After an amount of compensation is determined, it is then assessed whether you have any liability for the injuries sustained. If you do, this reduces your compensation accordingly.

Strategies For Maximizing Compensation

The simplest strategy to maximize compensation is to preserve evidence, follow all recommended treatments and healing, substantiate every detail of your claim, think about present and future damages, and build your case carefully.

Understanding Settlements In Personal Injury Cases

It is best to secure settlements out of court for all parties involved. It takes less time, costs less money, and utilizes less resources. If an insurance company believes they will lose a case, they will try to settle out of court. In personal injury cases, most are settled accordingly. Even with a settlement, you can still maximize your compensation due to the risk of what could transpire before a judge.

Our Fees

For personal injury, disability, and employment cases, we work on a contingency fee basis, which means you will only have to pay a fee if and when we obtain a settlement or judgment in your case.

We understand that many of our clients struggle financially after a life-changing event, such as a car accident, and we therefore give our clients the ability to retain us without having to pay for our services up front. In a case, we also cover any expenses, known as disbursements, which are only paid back out of a settlement or judgment. Further, if your case is not successful, you will not be required to pay us any fees.

In accordance with the Law Society of Ontario, we generally charge a contingency fee between 20% and 33% of your settlement, plus HST. However, the percentage we decide to charge will be based on the severity of your injuries and the complexity of your case.

Please call us for further information and to discuss how we can help you.
